Improve environmental stewardship by using a contractor that has a formal environmental management process.
The prime contractor, design-builder or construction management firm shall have a documented environmental management system (EMS) for the entire company or at least the portion(s) of the company participating in the project. The EMS must be in place for the duration of project construction. As a minimum, the EMS and its documentation shall meet the requirements of International Standards Organization (ISO) 14001:2004.

Given that a consultant’s EMS likely wouldn’t coincide with NPS EMSs for transportation functions, the argument against certification of contractors outweighs the argument for keeping this as a credit.
Drop EW-1 unless the NPS plans to develop EMSs for “transportation functions.”

According to EO 13423 it is the agencies’ responsibility for implementing an EMS for transportation functions. Contractors are only responsible for carrying out contract stipulation that ensure the EMS is properly addressed. Section 3b of the EO calls for agencies to implement EMSs at appropriate organizational levels “as the primary management approach for addressing environmental aspects of . . . transportation functions . . .” The instructions for implementing this EO calls for agencies to stipulate in their contracts requirements “to ensure that the contractors’ roles and responsibilities under the EMS are properly addressed.” In other words, agencies, not contractors, are responsible for developing and implementing EMSs specific to each agency.
If the NPS has applicable EMSs, then EW-1 should be revised to reflect this. Points could be given for projects that demonstrate elements of a NPS EMS were applied.
