Goal
Incorporate construction quality into the public low-bid process through the use of
warranties.
Requirements
The project construction contract shall include, as a minimum, a 3-year warranty for
constructed portions of the pavement structure to include surfacing (e.g., hot mix
asphalt, portland cement concrete, etc.) as well as any underlying layers (e.g., granular
base material). Other items may also be included in the warranty but are not required
to be for this credit.
The terms of the warranty shall be defined by the owner and may include contractor
input if desired. As a minimum, the contractual warranty clause shall include:
- Definition of what product(s) are warranted.
- Length of the warranty period.
- Responsibilities of the owner.
- Responsibilities of the contractor.
- Responsibility for maintenance.
- Conflict resolution process.
- Performance indicators and associated threshold levels that require corrective
action by the contractor.
- Requirements for corrective action.
- Basis of payment.

Thanks for the comment JonathanB. The answer to your first question is no, because that level of specificity is between the parties in the contract. For your second question, the answer is also no, for similar reasons. An agency may provide such a report to Greenroads at their discretion. At this time, the existence of a warranty meeting the requirements stated in this credit is sufficient to earn the credit. The enforcement of the warranty is another issue that is to be handled by the contracted parties.
Should the warranty not also stipulate that any corrective action, will be in compliance with Greenroads standards of 'Green' construction? Is the agency also required to report to Greenroads, what corrective action was made, and what methods were used, in order to maintain credits?
